Handelsonderneming M. van der Molen takes your privacy very seriously. We therefore only process data that we need to provide and improve our services, and we handle the information we have collected about you and your use of our services with the utmost care. We never make your data available to third parties for commercial purposes.
 

This privacy policy applies to the use of the website and the services provided by Handelsonderneming M. van der Molen. These terms and conditions came into effect on 26 March 2019; the publication of a new version renders all previous versions invalid. This privacy policy describes what data we collect about you, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you provide to us. E-commerce software

Shopfactory

Our online shop has been developed using software from Shopfactory. Personal data that you provide to us for the purpose of our services will be shared with this party. Shopfactory has access to your data in order to provide us with (technical) support; they will never use your data for any other purpose. Under the agreement we have concluded with them, Shopfactory is obliged to take appropriate security measures. Shopfactory uses cookies to collect technical information relating to your use of the software; no personal data is collected and/or stored.

Webhosting

Hostnet (hosting)

We use Hostnet for our web hosting and email services. Hostnet processes personal data on our behalf and does not use your data for its own purposes. However, Hostnet may collect metadata regarding the use of the services. This does not constitute personal data. Hostnet has implemented appropriate technical and organisational measures to prevent the loss and unauthorised use of your personal data. Hostnet is bound by a confidentiality agreement.

Hostnet (email)

We use Hostnet’s services for our regular business email correspondence. Hostnet has implemented appropriate technical and organisational measures to prevent, as far as possible, the misuse, loss or corruption of your and our data. Hostnet does not have access to our inbox, and we treat all our email correspondence as confidential.

Payment processors

Buckaroo

We use the Buckaroo platform to process (part of) the payments in our online shop. Buckaroo processes your name, address and place of residence details, as well as your payment details such as your bank account or credit card number. Buckaroo has taken appropriate technical and organisational measures to protect your personal data. Buckaroo reserves the right to use your data to further improve its services and, in that context, to share (anonymised) data with third parties. In the event of a request for deferred payment (credit facility), Buckaroo shares personal data and information regarding your financial position with credit reference agencies. All the safeguards mentioned above regarding the protection of your personal data also apply to those parts of Buckaroo’s services for which it engages third parties. Buckaroo does not retain your data for longer than is permitted under the statutory time limits.

Reviews

Webwinkelkeur

We collect reviews via the Webwinkelkeur platform. If you leave a review via Webwinkelkeur, you are required to provide your name and email address. Webwinkelkeur shares this information with us so that we can link the review to your order. Webwinkelkeur also publishes your name on its own website. In some cases, Webwinkelkeur may contact you to ask for clarification regarding your review. If we invite you to leave a review, we will share your email address and invoice number with Webwinkelkeur. They will use this information solely for the purpose of inviting you to leave a review. Webwinkelkeur has implemented appropriate technical and organisational measures to protect your personal data. Webwinkelkeur reserves the right to engage third parties for the purpose of providing its services; we have given Webwinkelkeur permission to do so. All the safeguards mentioned above regarding the protection of your personal data also apply to those parts of Webwinkelkeur’s services for which they engage third parties. Webwinkelkeur will retain your personal data for as long as you keep the review published on the platform. Shipping and logistics

PostNL

When you place an order with us, it is our responsibility to arrange for your parcel to be delivered to you. We use the services of PostNL to carry out these deliveries. To do so, we need to share your name, address and place of residence details with PostNL. PostNL uses this information solely for the purpose of fulfilling the contract. In the event that PostNL engages subcontractors, PostNL will also make your details available to these parties.  

Invoicing and bookkeeping

Davilex

We use the services of Davilex to manage our administration and accounts. We share your name, address and place of residence details, as well as details relating to your order. This information is used to process sales invoices. Your personal data is transmitted and stored securely. Davilex is bound by a duty of confidentiality and will treat your data as confidential. Davilex will not use your personal data for any purposes other than those described above.

Purpose of data processing

General purpose of the processing

We use your data solely for the purpose of providing our services. This means that the purpose of processing is always directly related to the instruction you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later date – other than at your request – we will ask for your explicit consent to do so. Your data will not be shared with third parties, other than to comply with accounting and other administrative obligations. These third parties are all bound by a duty of confidentiality under the agreement between them and us, or by an oath or legal obligation.

Data collected automatically

Data collected automatically by our website is processed with the aim of further improving our services. This data (such as your IP address, web browser and operating system) does not constitute personal data.

Cooperation in tax and criminal investigations

In certain circumstances, Handelsonderneming M. van der Molen may be required by law to disclose your data in connection with a tax or criminal investigation conducted by the authorities. In such cases, we are obliged to disclose your data, but we will oppose this to the extent permitted by law.

Retention periods

We will retain your data for as long as you remain our client. This means that we will retain your client profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also regard this as a request to be forgotten. In accordance with applicable administrative obligations, we are required to retain invoices containing your (personal) data; we will therefore retain this data for as long as the applicable retention period applies. However, employees will no longer have access to your client profile or to documents we have produced in connection with your engagement.

Your rights

Under current Dutch and European legislation, as a data subject, you have certain rights regarding the personal data processed by or on behalf of us. We explain below what these rights are and how you can exercise them. In principle, to prevent misuse, we will only send copies of your data to the email address we already have on file. If you wish to receive the data at a different email address or, for example, by post, we will ask you to verify your identity. We keep a record of processed requests; in the case of a right to be forgotten request, we process anonymised data. You will receive all extracts and copies of data in the machine-readable data format that we use within our systems. You have the right at any time to lodge a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data in an inappropriate manner.

Right of access

You always have the right to access the data that we process (or have processed) and that relates to you or can be traced back to you. You may submit a request to this effect to our privacy contact. You will then receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data to the email address we have on file, together with a list of the processors holding this data, specifying the category under which we have stored this data.

Right of rectification

You always have the right to request that any personal data we process – or have processed – which relates to you or can be traced back to you, be amended. You may submit a request to this effect to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address we have on file stating that the data has been amended.

Right to restriction of processing

You always have the right to restrict the processing of personal data relating to you or which can be traced back to you. You may submit a request to this effect to our privacy contact. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we hold, stating that the data will no longer be processed until you lift the restriction.

Right to portability

You always have the right to have the data that we process (or have processed) and that relates to you personally or can be traced back to you transferred to another party. You may submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you, to the email address known to us, copies or extracts of all data concerning you that we have processed or that has been processed on our behalf by other processors or third parties. In all likelihood, we will no longer be able to continue providing our services in such a case, as the secure linking of data files can then no longer be guaranteed.

Right to object and other rights

Where applicable, you have the right to object to the processing of your personal data by or on behalf of Handelsonderneming M. van der Molen. If you object, we will immediately cease processing your data pending the resolution of your objection. If your objection is justified, we will provide you with copies of the data we process (or have processed) and will then permanently cease processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Cookies from the US company Google are placed via our website as part of the ‘Analytics’ service. We use this service to track and receive reports on how visitors use the website.
